Terms of Service

Plain language, and short enough to actually read. If anything here is unclear, ask before you agree to it — eric@planyourset.com.

Plan Your Set is run by Eric Haley, and these terms are the agreement between us and your team. Using the service means you accept them.

Throughout, your team means the account you create — a church, a worship team, a touring band, or you on your own. The app says "church" throughout because that is where this started and where most of it is used; these terms mean whichever one you are.

What Plan Your Set is

A web application for planning worship sets: a song library, arrangements, set lists, practice mixes, a schedule, a stage plot, and the ability to generate an Ableton Live session from a set you have built.

It is software, not a music licence. Nothing here gives you the right to use, copy, perform or distribute any piece of music. Section 5 covers that, and it is the most important section on this page.

Your account

You need an account, and the account belongs to a person, not to a role — don't share one login around a team. Anyone who needs access can have their own; the price is per team, not per person.

You are responsible for what happens under your login, so keep the password to yourself and tell us promptly if you think someone else has it. You must be old enough to enter a contract where you live, and if you're signing up on behalf of a church or other organisation, you're confirming you're allowed to.

Your team

Creating an account creates a team, and whoever created it is its admin. Admins can invite others, set what each person can do, and handle billing.

There are three levels of access:

  • Viewer — can see and play back everything.
  • Editor — can build and edit sets, songs, arrangements and stems.
  • Admin — everything above, plus invitations, members, billing and team settings.

A team's admins control that team's content and can remove anyone's access to it, including yours. If you belong to more than one team, each is separate — leaving one doesn't affect the others.

Your content stays yours

We claim no ownership of anything you upload. Your songs, arrangements, stems, set lists, schedules and stage plots are yours. We don't sell them, we don't train anything on them, and we don't share them with other teams.

To actually run the service we need your permission to store your files, move them between our servers and your browser, make the copies the product depends on — practice mixes, playback previews, the audio inside a generated Ableton session — and show them back to the people on your team. That permission is limited to operating Plan Your Set for you, it isn't exclusive, and it ends when you delete the content or close the account.

You can take your work with you: sets export to Ableton sessions and PDFs, and your original uploads are the files you gave us. If you need a bulk copy of anything, ask and we'll help.

Music rights are yours to hold

You are responsible for having the right to use every file you upload. Multitracks and stems are licensed separately from the songs themselves — a CCLI licence covers reproducing and performing a song, and generally does not cover using a commercial multitrack. Those come with their own terms from whoever sold them to you.

By uploading anything you confirm you have the rights or permissions you need for it, and for what Plan Your Set does with it — storing it, transposing it, rearranging it, mixing it, and putting it into a session your team plays on a Sunday.

We don't check that, and we can't. What we will do is act on a credible rights complaint: if a copyright owner tells us something on our servers infringes their rights, we may remove it and, for repeat cases, close the account. Send those to eric@planyourset.com with enough detail to identify the work and the file, and we'll tell the team so they can respond.

What you may not do

  • Upload anything you don't have the rights to, or use the service to distribute music beyond your own team.
  • Share stem downloads or practice-mix links outside the people who are meant to have them.
  • Resell, sublicense or white-label the service, or run another organisation's operation from your subscription.
  • Try to reach other teams' data, work around the plan limits, or attack the service.
  • Upload anything unlawful, or anything containing malware.
  • Scrape or bulk-download the service by automated means.

Storage is generous but not unlimited. There is a fair-use line set far above what a worship library accumulates over years of Sundays, and if you ever approached it we'd talk to you about it rather than quietly switch something off.

The free plan

Free means free, with no time limit and no card. It holds up to ten songs, three of them with stems and full arrangements. It's meant to be enough to build a real set and see whether the workflow fits your team.

We may change what the free plan includes for new sign-ups. If we ever reduce it for teams already on it, we'll tell you first.

Subscriptions and payment

The full plan is $29 USD per month, or $290 USD per year — the same plan either way, priced per team however many people you have. It renews automatically, monthly or yearly to match what you chose, until it's cancelled.

You can move between monthly and yearly whenever you like, under Billing in the app. When you switch, we credit whatever is left of the period you've already paid for against the new one, so you're never charged twice for the same week.

Payment is handled by Stripe. Your card details go straight to Stripe and are never stored on or seen by our servers — we keep only Stripe's customer reference and your subscription's status. Using the service means also accepting Stripe's terms for the payment itself.

Tax

Prices are shown before tax. Where we're required to collect sales tax or VAT, it's calculated at checkout and added to your total. Being a church doesn't automatically make a purchase exempt from sales tax — if your organisation holds an exemption, contact us before subscribing and we'll set it up on your account.

If a payment fails

Nothing stops immediately. Stripe will email you and retry the card over the following weeks, and you keep full access throughout — we're not going to take a worship team's tracks away mid-week over an expired card. If it's still unpaid when Stripe gives up, the subscription ends and section 9 applies.

Price changes

We may change the price with at least 30 days' notice by email. If you don't want the new price, cancel before it takes effect.

Cancelling, and what happens to your work

Cancel any time from Billing in the app. Cancellation takes effect at the end of the period you've already paid for — you keep the full plan until then.

Nothing you have uploaded is deleted when a subscription ends. Your library stays exactly as it was. What changes is how much of it you can use: you keep the free plan's allowance, chosen from what you already have — ten songs, and stems and arrangements on three of them. Those are your ten oldest songs and the three you added audio to first, decided once at the moment the subscription ends and then left alone.

The rest stay in your library, listed and labelled, and are locked rather than removed: you can't play them, export them or add them to a set until you subscribe again. Resubscribe and everything unlocks exactly as it was. You can carry on using the free plan indefinitely.

Refunds

We don't automatically refund part-months, since cancelling leaves you with the rest of the period you paid for. That said — if you were charged for a month you didn't mean to renew, or something went genuinely wrong, email us. We'd rather sort it out than have you feel stung by a $29 charge.

On the yearly plan, you can have all of it back within 30 days. If you email us within 30 days of a yearly charge, we'll refund the full $290, no reasons asked for. After 30 days we don't refund the unused part of a year, but you keep the full plan right through to the end of it — and the same "email us if something went wrong" applies as it does on monthly.

Availability, and things breaking

We run this every Sunday ourselves, so we care a great deal about it working. But it's a small service and we don't offer a guaranteed uptime level. There will be maintenance, and occasionally there will be faults.

Keep your own copies of your multitracks. We back the service up and we take your files seriously, but no online service should be the only place your audio exists — that's true of us and of everyone else.

Features may change, improve or be retired as the product develops. Where a change would meaningfully affect how you work, we'll tell you.

Plan Your Set generates Ableton Live sessions. Ableton is not affiliated with us, and we don't guarantee any particular version of Live will open a session, or that a generated session is fit for any particular service. Check it before Sunday.

Ending an account

You can close your team's account at any time by asking us. We'll delete its content within 30 days, other than anything we're required to keep for accounting or legal reasons.

We may suspend or close an account that breaks these terms — particularly section 5 or 6 — or where we're required to. Except for serious or repeated breaches we'll warn you first and give you a chance to put it right. If we close a paid account for anything other than a breach, we'll refund the unused part of the month.

Warranties and liability

The service is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special or consequential damages, or for lost profits or lost data. Our total liability for any claim is capped at the amount you paid us in the twelve months before it arose, or $29 if you were on the free plan.

Nothing here limits liability for fraud, or for anything else that can't lawfully be limited. Some jurisdictions don't allow parts of these exclusions, in which case they apply to you only as far as the law permits.

Changes to these terms

We may update these terms. If a change is significant we'll email account admins and update the date at the top at least 14 days before it takes effect. Carrying on using the service after that means accepting the new version; if you'd rather not, cancel.

Law, and sorting out disagreements

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts located in Tarrant County, Texas, and we both agree to that venue.

Before either of us files anything, let's talk: email eric@planyourset.com and give us 30 days to sort it out directly. Most things are a misunderstanding and a phone call.

If any part of these terms is unenforceable, the rest still stands. These terms plus the Privacy Policy are the whole agreement between us about the service.
